Membership Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Happy Hour Club website (happyhourclub.com.au) and app (together, the "Platform"), operated by Happy Hour Club Co Pty Ltd (ACN 679 947 169) ("Happy Hour Club", "HHC", "we", "us", "our"). By creating a membership account or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. What Happy Hour Club is

Happy Hour Club is a free digital membership platform that connects members with exclusive drink and hospitality deals at independently owned and operated partner venues ("Venue Partners") across Sydney, along with discounts from brand partners ("Brand Partners"). Membership is free. We do not charge members for access to the Platform, deals, or perks.

2. Eligibility

To become a member, you must:

  • Be at least 18 years of age;

  • Provide accurate and complete information when signing up (including your genuine date of birth); and

  • Be capable of forming a legally binding contract under Australian law.

Happy Hour Club deals relate to venues that serve alcohol. We reserve the right to refuse, suspend, or terminate membership if we reasonably believe you do not meet these requirements.

3. Your membership account

You are responsible for keeping your account information accurate and up to date, and for maintaining the confidentiality and security of your digital membership card. Your membership is personal to you and is not transferable. You must not let another person use your digital membership card or account to redeem deals on your behalf.

Membership is issued via a digital card added to Apple Wallet or Google Wallet, or accessed within the app. You are responsible for keeping the device on which your card is stored secure.

4. Deals, redemptions, and venue relationships

HHC is a marketplace, not the venue. Deals are offered directly by independent Venue Partners, not by Happy Hour Club. Happy Hour Club is not a party to, and has no control over, the sale or service of food, drinks, or alcohol at any venue. Each Venue Partner is solely responsible for the quality, safety, availability, pricing, and legality of the products and services it provides, including compliance with responsible service of alcohol (RSA) laws.

Deals shown on the Platform:

  • Are set and controlled by the relevant Venue Partner and may change, be limited in availability, or be withdrawn at short notice;

  • Are subject to each venue's own house policies, capacity, and discretion (including the right to refuse service in accordance with the law);

  • Are not guaranteed to be available at any specific time, and Happy Hour Club does not guarantee that any deal displayed on the Platform is currently honoured by the venue; and

  • May require presentation of your valid digital membership card and, where applicable, proof of age.

Happy Hour Club is not liable for any dispute, loss, injury, or dissatisfaction arising from your visit to, or purchase from, any Venue Partner. Any such dispute is between you and the venue directly.

5. Brand Partner perks

The Perks section of the Platform features discounts and offers from independent Brand Partners. As with Venue Partner deals, these offers are controlled by the relevant Brand Partner, are subject to change or withdrawal, and any transaction you enter into with a Brand Partner (including use of a promo code) is between you and that Brand Partner. Happy Hour Club is not responsible for the products, services, or conduct of Brand Partners.

6. Acceptable use

When using the Platform, you agree not to:

  • Provide false information, including a false date of birth;

  • Share, sell, or allow another person to use your membership card;

  • Attempt to redeem a deal fraudulently or outside the terms it was offered on;

  • Use the Platform for any unlawful purpose, or in a way that could damage, disable, or impair the Platform;

  • Attempt to reverse engineer, scrape, or interfere with the Platform's systems; or

  • Post or transmit abusive, defamatory, or unlawful content via any social or group features on the Platform.

7. Notifications and communications

By joining, you consent to receive push notifications and emails relevant to your membership (such as deal alerts, streak updates, and account notices). You can manage these preferences at any time in your profile settings, in accordance with our Privacy Policy.

8. Suspension and termination

We may suspend or terminate your membership, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent or abusive conduct, or misused your membership card. You may close your account at any time via the app or by contacting hello@happyhourclub.com.au.

9. Intellectual property

The Platform, including its design, branding, logos, and content created by Happy Hour Club, is owned by or licensed to Happy Hour Club Co Pty Ltd and is protected by copyright and other intellectual property laws. You may not copy, reproduce, or use our branding or content without our prior written consent.

10. Disclaimers

The Platform is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranty that the Platform will be uninterrupted, error-free, or that any particular deal will be available. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, Happy Hour Club's total liability to you arising out of or in connection with your use of the Platform is limited to re-supplying the relevant part of the Platform's services, or (at our option) the amount you have paid us for membership in the preceding 12 months (which, given membership is free, is nil). We are not liable for any indirect, consequential, or special loss, or for the acts or omissions of Venue Partners or Brand Partners.

12. Indemnity

You agree to indemnify Happy Hour Club against any claims, losses, or costs arising from your breach of these Terms or misuse of the Platform, to the extent permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified via the app or by email. Continued use of the Platform after changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
